COAG x THE BIG ISSUE — “50 YEARS OF PUNK”

 

CAMPAIGN TERMS & CONDITIONS

This document sets out the legally binding terms and conditions (“Terms”) governing the operation of and participation in the COAG x The Big Issue “50 Years of Punk” fundraising campaign and all associated prize draws (the “Campaign”).

 

By purchasing an entry, submitting an entry, or otherwise participating in the Campaign, you (“Entrant”, “you”, “your”) agree to be legally bound by these Terms.

 

 

1. PARTIES

1.1 The promoter and operator of the Campaign is:

(“Promoter”, “Operator”, “COAG”, “we”, “us”, “our”).

 

1.2 The fundraising beneficiary is:

 

Big Issue Media Ltd (“The Big Issue”)

Company Number: 02612480

Registered Address: 113–115 Fonthill Road, London, N4 3HH

(“Beneficiary”).

 

1.3 The Big Issue is not the promoter, operator, administrator, organiser, or seller of entries and shall have no responsibility for the operation, management, administration, compliance, or fulfilment of the Campaign. 

 

 

 

2. DEFINITIONS AND INTERPRETATION

 

 

2.1 In these Terms, unless the context requires otherwise:

 

(a) “Campaign” means the fundraising prize draw campaign titled “COAG x The Big Issue — 50 Years of Punk”.

(b) “Draw” means a single prize draw associated with a specific prize.

(c) “Entry” means a valid paid entry submitted via the Campaign entry system.

(d) “Entry Package” means a paid bundle of entries offered at a stated price.

(e) “Prize” means the item, artwork, or object designated as the prize for a Draw.

(f) “Winner” means the Entrant selected by random draw as the winner of a Draw.

(g) “Platform Provider” means any third-party service provider used by COAG in connection with Campaign operations, including Shopify, payment processors, and prize draw administration platforms.

 

2.2 Headings are for convenience only and do not affect interpretation.

 

2.3 Words importing the singular include the plural and vice versa.

 

 

 

3. CAMPAIGN PURPOSE AND NATURE

 

 

3.1 The Campaign is a fundraising initiative operated by COAG in support of the Beneficiary.

 

3.2 The Campaign consists of a series of prize draws whereby Entrants may purchase Entries for the opportunity to win a Prize.

 

3.3 Entry payments support the Campaign’s fundraising purpose. The purchase of an Entry does not constitute the purchase of any artwork, product, investment, or commercial asset.

 

3.4 Participation in the Campaign does not guarantee that an Entrant will win a Prize.

 

 

 

4. OPERATION AND RESPONSIBILITY

 

 

4.1 COAG is the sole promoter and operator of the Campaign.

 

4.2 COAG is responsible for all Campaign functions including (without limitation):

 

(a) administration and management of Entries;

(b) compliance and record keeping;

(c) draw execution and winner selection;

(d) winner notification;

(e) prize fulfilment, delivery, or collection arrangements.

 

4.3 The Beneficiary shall have no responsibility for:

 

(a) the operation of the Campaign;

(b) the processing of Entries or payments;

(c) the selection of Winners;

(d) the fulfilment or delivery of Prizes;

(e) any regulatory or compliance obligations connected to the Campaign. 

 

 

 

5. REGULATORY COMPLIANCE AND STRUCTURAL FLEXIBILITY

 

 

5.1 COAG shall operate the Campaign in accordance with all applicable laws, licensing requirements, and regulatory guidance in force in England and Wales.

 

5.2 The Campaign may be structured as a series of prize draws, including operation as a Small Society Lottery registered with the relevant local authority, or any other lawful prize-based mechanism determined by COAG to ensure compliance. 

 

5.3 COAG reserves the right, acting reasonably and in good faith, to amend the regulatory mechanism, administrative structure, draw timing, or operational format of the Campaign where required to maintain legal compliance or fairness, provided that such changes do not materially alter the overall fundraising purpose of supporting the Beneficiary. 

 

 

 

6. ELIGIBILITY

 

 

6.1 Entry is open only to individuals who are:

 

(a) aged 18 years or older at the time of entry; and

(b) legally permitted to participate under applicable law.

 

6.2 COAG reserves the right to refuse Entries from any individual or jurisdiction where participation would be unlawful or impractical.

 

6.3 COAG reserves the right to request proof of identity, proof of age, and proof of address at any stage, including prior to awarding a Prize.

 

6.4 COAG may, where necessary for fairness and integrity, restrict or exclude participation by COAG staff, contractors, or any person closely connected to Campaign administration.

 

 

 

7. ENTRY PROCEDURE

 

 

7.1 Entries must be submitted online through the official Campaign entry platform hosted on COAG’s website and/or associated checkout system.

 

7.2 An Entry shall only be deemed valid when payment has been successfully processed and recorded.

 

7.3 COAG shall not be responsible for Entries that are lost, incomplete, delayed, corrupted, misdirected, or not received due to technical, network, system, platform, payment, or device issues beyond COAG’s reasonable control.

 

7.4 Entrants are responsible for ensuring that all personal information submitted is complete and accurate.

 

 

 

8. ENTRY PACKAGES, PRICING AND LIMITATIONS

 

 

8.1 COAG may offer Entry Packages at different price points. The number of Entries provided per package shall be stated clearly at the point of purchase.

 

8.2 COAG reserves the right to:

 

(a) introduce new Entry Packages;

(b) amend Entry Package pricing;

(c) remove Entry Packages;

(d) set maximum entry limits per person, household, payment method, email address, or other identifier,

where necessary to ensure fairness, prevent abuse, or meet compliance requirements.

 

8.3 Any amendments to Entry Packages shall not affect valid Entries purchased prior to the amendment.

 

 

 

9. DRAW PERIODS AND CAMPAIGN TIMINGS

 

 

9.1 Each Draw shall have its own stated opening date/time and closing date/time.

 

9.2 COAG reserves the right to extend, shorten, postpone, or amend Draw dates where required for:

 

(a) compliance;

(b) fairness;

(c) operational integrity;

(d) technical issues;

(e) force majeure events.

 

9.3 Updated timings shall be published on the Campaign page.

 

 

 

10. WINNER SELECTION

 

 

10.1 Winners shall be selected fairly at random from all valid Entries received prior to the closing time of the relevant Draw.

 

10.2 Winner selection may be conducted by:

 

(a) a random number generator;

(b) an auditable draw process;

(c) a third-party prize draw administration platform.

 

10.3 COAG’s draw result shall be final, subject always to applicable law.

 

 

 

11. WINNER NOTIFICATION AND ACCEPTANCE

 

 

11.1 COAG shall notify the Winner using the contact details supplied at the time of entry.

 

11.2 The Winner must respond within fourteen (14) days of notification unless otherwise stated.

 

11.3 Where the Winner fails to respond within the stated period, fails to provide requested verification, or is found to be ineligible, COAG reserves the right to:

 

(a) disqualify the Winner; and/or

(b) select an alternative Winner.

 

11.4 COAG shall have no liability to any Entrant for failure to receive notification due to incorrect contact information or email delivery issues.

 

 

 

12. PUBLICATION OF WINNER DETAILS

 

 

12.1 COAG may publish Winner details (including first name and surname initial and general location) for transparency, reporting, and compliance purposes.

 

12.2 Winners may object to publication by contacting COAG in writing. COAG may still be required to disclose Winner details to regulators, auditors, or authorities where legally required.

 

 

 

13. PRIZES

 

 

13.1 Each Prize shall be described on the relevant Draw page.

 

13.2 Unless expressly stated otherwise:

 

(a) Prizes are non-transferable;

(b) no cash alternative is available;

(c) Prizes may not be substituted or exchanged at the request of the Winner.

 

13.3 COAG reserves the right to substitute a Prize with a prize of equal or greater value where necessary due to circumstances outside COAG’s reasonable control.

 

13.4 Due to the nature of physical artworks and objects, minor variations in framing, finish, packaging, or condition may occur and shall not constitute a breach of these Terms.

 

 

 

14. PRIZE FULFILMENT, DELIVERY AND RISK

 

 

14.1 COAG shall be responsible for arranging delivery or collection of Prizes.

 

14.2 The Beneficiary shall bear no responsibility for delivery, fulfilment, or any Prize-related matter. 

 

14.3 COAG shall use reasonable efforts to fulfil Prizes within thirty (30) days of the Draw date, subject to logistical constraints.

 

14.4 Where Prizes require shipping outside the United Kingdom, the Winner may be responsible for customs duties, taxes, import charges, or clearance fees.

 

14.5 Risk in the Prize shall transfer to the Winner upon delivery or collection.

 

 

 

15. PAYMENTS, REFUNDS AND CANCELLATIONS

 

 

15.1 Payments are processed through Shopify and/or associated third-party payment processors.

 

15.2 COAG shall not be liable for payment processing delays, failures, or interruptions caused by third-party providers.

 

15.3 Entries are generally non-refundable once purchased.

 

15.4 Refunds may be issued only where:

 

(a) a Draw is cancelled;

(b) duplicate payment occurs due to a verified technical error; or

(c) a refund is required under applicable consumer law.

 

15.5 COAG reserves the right to refuse refunds where fraud, manipulation, chargebacks, or abusive behaviour is suspected.

 

15.6 COAG reserves the right to cancel, suspend, or amend any Draw where necessary due to fraud, technical failure, platform outage, compliance concerns, or circumstances outside COAG’s reasonable control. Where a Draw is cancelled, COAG will refund valid paid Entries where appropriate.

 

 

 

16. DATA PROTECTION AND MARKETING CONSENT

 

16.1 These Terms are separate from COAG’s Privacy Policy and Cookie Policy.

 

16.2 COAG shall process personal data in accordance with UK data protection law, including the UK GDPR and Data Protection Act 2018.

 

16.3 COAG is the Data Controller in relation to personal data collected through the Campaign entry system.

 

16.4 Where personal data is shared with The Big Issue, The Big Issue shall act as an independent Data Controller for the data it receives and processes. 

 

16.5 COAG shall only share personal data with The Big Issue where the Entrant has provided appropriate consent or another lawful basis applies and is disclosed.

 

16.6 Entrants may be provided with separate opt-in options to receive communications from COAG and separate opt-in options to receive communications from The Big Issue. Marketing consent is optional and may be withdrawn at any time.

 

16.7 COAG reserves the right to retain personal data for Campaign administration, compliance, fraud prevention, and regulatory record keeping purposes.

 

 

 

17. FRAUD, MISUSE AND DISQUALIFICATION

17.1 COAG reserves the right to disqualify any Entrant and void any Entries where COAG reasonably believes that the Entrant has:

(a) breached these Terms;

(b) provided false or misleading information;

(c) used automated systems or manipulation to generate Entries;

(d) engaged in fraudulent payment activity or chargebacks;

(e) attempted to interfere with the Campaign platform or fairness of the Draw.

 

17.2 COAG’s decision to disqualify an Entrant shall be final, subject to applicable consumer law.

 

18. LIABILITY, LIMITATIONS AND GOVERNING LAW

18.1 COAG shall not be liable for any indirect or consequential losses, including loss of profit, loss of opportunity, or reputational damage arising from participation in the Campaign.

18.2 COAG shall not be liable for any failure or delay in performance caused by circumstances outside its reasonable control, including but not limited to technical outages, payment provider failure, courier disruption, strikes, or regulatory intervention.

18.3 Nothing in these Terms excludes or limits liability for fraud, death, personal injury caused by negligence, or any liability that cannot legally be excluded.

18.4 If any provision of these Terms is found unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

18.5 These Terms shall be governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.

These Terms should be read alongside COAG’s Privacy Policy, Cookie Policy, and Refund Policy.

Where you opt in to receive communications from The Big Issue, your personal data will be processed by The Big Issue in accordance with its own privacy policy.
